A postnup can prove to be very beneficial during a divorce in Florida. This type of agreement provides a guide as to how your assets get divided if you and your spouse separate, and it protects minor children if one parent dies. Here are some of the reasons why you may want to consider getting a postnup.

You each bring a lot of money into the marriage

It’s not uncommon for wealthy individuals to choose to have a postnup drawn up. A high-asset divorce can get very complicated as it is often difficult to determine who gets which asset. A postnup takes care of all of this, so most individuals get to keep what they brought into the marriage.

One party owns a business

Many individuals open up a business after they get married. If they are the only one working and contributing to the business, they may feel entitled to keep everything they earned and not want to split the profits during a divorce. In many cases, a postnup will allow them to keep a good portion of the earnings of the business, and the other party may only end up receiving a small percentage of it.

There are children from a previous relationship

An individual may have concerns about their children from a previous relationship and whether or not they will get an inheritance if they die. A postnup can address how the deceased individual’s estate gets split upon their passing, and they can choose to leave a good chunk of it to their children.

If an individual doesn’t get the chance to create a prenup, they may want to consider having a postnup created after they get married. It can provide them with the financial protection they need during a divorce and protect their children in the event of their untimely passing.
