What Is A Prenup?

A prenuptial agreement is a contract between two people who plan to marry. Prenuptial agreements set forth rules to resolve potential problems of support and distribution of property at the end of the marriage on the death of either party or through divorce. Most people don’t think about their legal rights and duties when they decide to get married. Everyone immediately thinks about those rights when divorce is contemplated.

You can think of a prenuptial agreement as a will for your marriage. Just as a will can avoid some of the sticky problems of probate, a prenuptial agreement can avoid some of those same problems in probate or divorce.

The Benefits Of A Postnup?

There are several reasons why a couple might wish to have a postnuptial agreement. A couple that did not sign a prenuptial agreement before marriage may later decide that they want to have a financial plan in place in the event of death or divorce. If you are having problems in your marriage, this can be discussed and an agreement can be reached on how to handle certain issues if you cannot reconcile your differences and the marriage ends in divorce.

In many cases, post-nuptial agreements are used as part of a comprehensive estate plan. Or if there has been a substantial change or inheritance since the existing prenuptial agreement was created.

Due to limitations imposed by Florida statutes, post-nuptial agreement cannot be as comprehensive as a prenuptial agreement.
