Don’t assume your divorce will be over quickly

On Behalf of | Dec 14, 2018 | Divorce Mediation |

Once spouses wrap their minds around pulling the plug on their marriages, they often ask how quickly that they can finalize their divorce in their state. There’s no one simple answer to this question.

How long it takes to settle your divorce in Florida is contingent upon a variety of factors, many of which are outside of you, your ex’s and your attorney’s hands.

One of the fastest ways to end your marriage is by agreeing to an uncontested divorce. To do this, you and your ex will need to compromise on a division of assets, child custody and support. When you pursue this type of divorce, you simply sign a few pieces of paperwork. Your marriage can then be over in as little as a month.

Couples that are unable to get on the same page with one another will have to pursue a contested divorce. Considering how 13 percent of Floridians are divorced, it’s likely that a large percentage of these couples ended their marriages in the courtroom hashing out their issues in front of a judge.

Litigating an end to your marriage can take anywhere from several months to a year. Some delays in settling these types of divorce cases can be blamed on court calendars being notoriously overbooked.

If the prospect of it taking that long to settle your divorce seems daunting then mediation may be a better fit for you than litigation is. Mediators often have much more open schedules which can help couples resolve their differences in a just a few weeks.

Fort Myers couples who choose to mediate a settlement in their divorce may find it refreshing to know that if they’re unhappy with how the process is going, they can stop the process and allow a judge make decisions instead. Once spouses sign their agreement, the mediator can submit it to the court for a judge to sign off on finalizing your divorce.

How long it will take to finalize your divorce is largely contingent upon whether your divorce is contested or not. If it is, then the length of time that it takes to see the settlement process to a conclusion will largely depend on how quickly you and your ex can resolve financial and child custody issues. A divorce mediation attorney can help you decide if you’re ready for a new approach to resolving your differences.
