What is a parenting plan?

As Florida parents deal with the impact of divorce, they may be concerned about the effect on their children. Although a dissolution of marriage terminates a relationship between two spouses, it does not terminate a parent's relationship with a child. A parenting plan is designed to cultivate parent-child relationships in light of the change in family dynamics.

Establishing child custody in Florida

In Florida child custody determinations, the court has discretion to act as it deems is in the child's best interests. To guide the court's decision is a multi-factor test with several areas for the judge to consider before setting a custody arrangement. Many of the factors examine the child's school and home history. Any incidents of domestic violence are reviewed. The level of involvement each parent has in the child's life is evaluated . As much as possible, and when favorable for the child, the court seeks to provide continuity in the child's life.

Judge orders children into public school during divorce hearing

A Florida judge unexpectedly ordered a mother to place her homeschooled children into a public school during a divorce hearing even though child custody and the children's education had not been placed in issue. The divorcing parents were in court on another issue when the children's guardian ad litem -- a person appointed by the court to represent the children's best interests --told the judge that she did not believe it was in the children's best interests for them to be homeschooled.
